General Terms and Conditions All business offers are carried out in a non-binding manner, and are subject to change. Errors, omissions, and subject to prior sale are excepted. The business offers are carried out under the premise that the receiver can acquire and use the offers accordingly. The offers are extremely confidential, and shall be assigned to a third party without written consent. Any infringement of the mention terms will result in the payment of commission.
If one of our offers is no longer available, it must be brought to our attention in the form of a letter within five (5) working days.
A standard commission will be taken when, and only when, a successful business transaction has been made. The contract must have been processed by or in accordance to our companys standard, and as a result of our support. The standard commission will remain when the closed contract results from the expiration of a resolute condition, or as a result of an alteration or any other invalid basis. Once a contract has been closed, the standard commission shall remain, even if the closure is a result of: expiration of a resolute condition, as a result of an alteration, or any other invalid basis.
The standard commission is due at the time of a successfully closed sale. We are entitled to a commission even if the business transaction does not result in an exchange of titles, but is a direct result of our work aiming towards our goal (for example, rent or contract of lease instead of a contract of sale, compulsory enforcement, the expansion of the offer, particularly in the concession of a license to sell).
It is stated in the unsolicited transcriptions of our business contract that we be notified in the case of supplementary or altered agreements involving this contract.
The amount of the brokers commission can not be explicitly agreed upon in written form in the advertisement or exposé. When a purchase or acquiring contract occurs as well as the purchase of a forced sale, pertaining to undeveloped or developed realty or similar land rights is the brokers commission 7,14% or the entire purchase price inclusive 19% general sales tax. With secured by lands registry charge rights to preemption the value of the property is measured with an additional 3,57% commission inclusive 19% general sales tax.
There is no assumed guarantee for accuracy and totality of the business offers. The particulars are derived by the respective vendors or leasers, and are not subjected to their accuracy being proven beforehand.
If several terms are ineffective, the virtue of the remaining terms should not be affected. The ineffective terms will be replaced with valid counterparts in which the economic use of the ineffective terms complies respectively to the new terms.
For independent commercial agents Berlin shall be the jurisdiction as well as the place of execution.
